Phelps Dunbar’s Petroleum Marketing practice is led by Karl Brandes, who has been part of roughly 30% of the Florida cases published in the Digest of Decisions under the Petroleum Marketing Practices Act. In each case, the oil company prevailed, either at trial, by summary judgment, or in the preliminary injunction proceeding.
The Petroleum Marketing practice extends well beyond cases involving the Petroleum Marketing Practices Act. Other types of cases that the group handles include antitrust, other trade regulation, contracts, business torts, environmental, products liability, personal injury, landlord/tenant, construction, and criminal matters. The group handles these types of matters on a frequent basis.
Phelps’ Petroleum Marketing experience also includes knowledge of industry “downstream” practices and procedures from the refinery to the port, to the remote pump dispensers. We also know the dealer plaintiffs’ dealers organizations and active plaintiffs’ counsel in this region. Further, we are familiar with the courthouses and maintain extensive files of orders favorable to marketers for attachment to any motion or other filing with the court.
