Michael Hunt represents both plaintiffs and defendants in complex commercial litigation and disputes involving design and construction. His litigation experience includes contract disputes, civil and criminal antitrust matters, environmental claims, expropriation and eminent domain actions, defense of federal and state securities law claims, disputes involving business torts, trade secrets and unfair trade practices. He has represented clients from many industries, including engineering and consulting firms, contractors, chemical and product manufacturers, financial institutions, insurers and public utilities.

Mr. Hunt counsels owners, contractors and specialty subcontractors on design/build and EPC projects, assisting with negotiations and contract drafting. He represents clients in disputes involving public bids and the prosecution of public contract claims against governmental entities. He has regularly represented clients in arbitration proceedings governed by the rules of the American Arbitration Association.

In addition to appearing in state and federal courts in Louisiana, Mr. Hunt has litigated matters in Alabama, California, Florida, Mississippi, North Carolina, South Carolina, Tennessee, Texas and Virginia.

Since 2008, Mr. Hunt has served as the managing partner of Phelps Dunbar LLP. 

Experience

  • Defending a capital markets investment bank against allegations of violations of Louisiana securities laws, breach of fiduciary duties, negligent misrepresentation, and other business torts. The claims are asserted on behalf of investors as derivative and class actions for persons who allegedly sustained hundreds of millions of dollars in losses.
  • Defending London Underwriters and London Market insurers against claims by the State of Louisiana for property damage coverage due to losses allegedly arising from hurricanes Katrina, Rita and Gustav.
  • Represented an international engineering firm in litigation in Louisiana and Texas arising out of the design and construction of a 140 mile interstate natural gas pipeline.
  • Representing the owner of a pipe manufacturing facility in a dispute with the design-build contractor. Claims of breach of contract and misrepresentation were tried in state court. After extensive appellate proceedings, final judgment was rendered in favor of our client.
  • Represented a national marketer of fly ash in litigation involving the design and construction of a barge loading facility.
  • Defending a former director against allegations that he violated Louisiana Securities Laws and committed other wrongs in connection with plaintiffs’ investment in a failed technology company. Claims against the defendants include alleged violations of Louisiana Securities laws (Blue Sky Laws); negligent or intentional misrepresentation; general tort claims; breach of fiduciary duties; breach of contract and/or rescission for failure of cause; detrimental reliance; and unjust enrichment.
  • Represented an attorney accused of breach of fiduciary duty and racketeering, arising from the sale of a real estate development. The case resulted in a successful jury verdict, affirmed on appeal.
  • Represented an electrical and instrumentation subcontractor in prosecuting claims relating to construction of a power plant in California.
  • Represented a chemical manufacturer in successfully prosecuting civil antitrust claims against suppliers of raw materials who conspired to fix prices.
  • Represented a chemical manufacturer in defense of claims by hundreds of landowners arising from the disposal of chemical waste at a landfill.
