Construction/Design

We work with clients at the front end of a construction project, when contracts are being negotiated and executed, all the way through design and construction.

Phelps Dunbar construction lawyers work day in, day out helping owners, developers, design professionals, and contractors bring their projects to life while minimizing the inherent risks in complex projects. We work with clients at the front end of a project, when contracts are being negotiated and executed, all the way through design and construction. Our areas of focus include:

  • Contract development and negotiation
  • Licensing issues
  • Risk avoidance
  • Bid protests
  • Environmental compliance
  • Dispute resolution through negotiation and mediation
  • Labor and employment
  • Alternative contract delivery

Gulf South Construction Track Record
Our firm’s footprint encompasses 10 offices in six states across the South. Our construction expertise mirrors the industries that drive the region’s economies. Because of the growth in the region, much of our work is centered on complicated infrastructure projects, including:

  • Industrial facilities
  • Highways
  • Bridges
  • Pipelines
  • Power plants

Our experience includes refineries, liquified natural gasification facilities, manufacturing facilities, hospitals, high-rise buildings, retail centers, condominium projects, and schools.

Troubled Construction Projects
Much of our work is centered around helping companies deal with the fallout when a construction project goes awry. We routinely serve as advocates in arbitration or litigation. Disputes resolved span a wide range of issues, including:

  • Impact and delay claims
  • Scope-of-work disputes
  • Design and construction defects
  • Cost overruns
  • Unforeseen site conditions
  • Geotechnical failures
  • Bid protests
  • Prevailing wage and labor issues
  • Takeover and completion assignments
  • Bond claims and liens

Beyond the Gulf South
Although the majority of our work is in the Gulf South, our clients’ projects take us throughout the United States and the Caribbean. We have litigated cases in federal and state courts across the country.
