Mr. Gabriel focuses on insurance coverage analysis and litigation primarily involving commercial liability, excess/umbrella, commercial auto, and commercial property policies. He handles a wide variety of coverage matters including additional insured and indemnity agreement issues, Stowers demands, allocation issues, Coverage B claims, MCS-90 and Form F claims, multi-carrier declaratory judgments, fine art/valuable articles claims, and subrogation issues. Mr. Gabriel also devotes a significant portion of his practice to first-party coverage and bad faith disputes arising out of hurricane, hail and wind storm claims.

Experience

  • Obtained federal district court summary judgment in hotly contested declaratory judgment coverage action related to serious injury case based on modified injury to employee exclusions contained in CGL policy.
  • Obtained summary judgment for insurers in numerous state and federal lawsuits involving coverage issues on liability and property claims.
  • Obtained federal court dismissal judgment for engineer clients in first-party case asserting claims of violations of the Texas Insurance Code.
  • Obtained defense verdict in trucking accident case with complex facts, successfully convincing federal court jury to place almost all liability on a responsible third party.
  • Negotiated settlements in numerous coverage, first-party, and insurance defense cases, including as specific example: favorable settlement in subrogation case involving disappearance of rare Victorian artifact collection.
