Annette Peltier practices in the area of litigation, primarily toxic tort litigation, including asbestos defense, general tort litigation and corporate defense, as well as other commercial litigation fields. She has worked in the area of toxic tort defense, environmental compliance, insurance defense and workers’ compensation defense since 1997.

Annette Peltier practices in the area of litigation, primarily toxic tort litigation, including asbestos defense, general tort litigation and corporate defense, as well as other commercial litigation fields. She has worked in the area of toxic tort defense, environmental compliance, insurance defense and workers’ compensation defense since 1997.

Ms. Peltier has defended asbestos, phosgene, vinyl chloride, hydrogen sulfide, sulfur dioxide and benzene maritime cases. She has helped to defend a railroad in two separate train derailment lawsuits in both federal and state courts. Her clients have included manufacturers, chemical and industrial plants, railroads, hospitals and insurance companies.

Prior to joining Phelps Dunbar in Baton Rouge, she worked as an attorney in Lake Charles, Louisiana.

Experience

  • Defended Shreveport chemical plant in related air contamination lawsuits, filed in both federal and state courts, brought by numerous individuals for personal injuries as well as several adjacent businesses for millions of dollars in economic losses caused by the alleged environmental nuisance. Engineered the pre-trial summary judgment dismissal of client in the federal litigation involving the economic losses and had primary responsibility for the subsequent appeal before the federal fifth circuit which affirmed the dismissal.
  • Defended major chemical company in intentional tort suit brought by employee for severe injuries caused by explosion at plant which released phosgene gas and other chemicals. Engineered pre-trial summary judgment dismissal of client based on workers’ compensation tort immunity defense and successfully convinced the state appellate court to uphold the dismissal.
  • Represented major chemical company in enforcement actions before the state environmental agency.
  • Defended major petroleum companies in several benzene exposure cases involving maritime products liability law.
  • Represented, from 1997 to 2001, major chemical company in all asbestos litigation throughout the state which included attendance at depositions, pre-trial motion practice, consultation with experts and preparation for trial.
  • Prepared legal arguments for client in asbestos case which resulted in pre-trial summary judgment dismissal based on workers’ compensation tort immunity defense subsequently upheld by state appellate court.
  • Defended a railroad company in train derailment litigation lawsuits, including a class action, which involved allegations of chemical exposure and issues of federal preemption.
