"Intellectual Property Playbook: A Game Plan to Protect Your Patents, Trademarks, and Copyrights"

Recent trends in the area of intellectual property law demonstrate the need for forward-thinking companies to implement both offensive and defensive strategies to protect their valuable patents, trademarks, and copyrights. The Supreme Court's decision in Alice Corp. v. CLS Bank and subsequent lower court and USPTO decisions implementing Alice show that courts are continually narrowing the scope of patent protection for computer-implemented inventions or methods of doing business. With these new restrictions on what can be patented, IP owners must develop a plan for targeted and creative patent drafting to protect their core inventions, as well as understand the new processes available under the America Invents Act to challenge others who may assert patents of questionable validity. In addition, we will address the need for trademark owners to implement cohesive branding strategies to ensure the strength of their marks. Finally, we will discuss the impact of the Supreme Court's recent decisions in Hana Financial v. Hana Bank and B&B Hardware v. Hargis Industries, Inc., as they apply to the development and protection of trademark portfolios.
